8.2 This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.

8.3 Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless SuperCalc Pro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another party
Financial decisions you make based on the Service

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL) or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

Under the ACL, you may have certain guarantees that cannot be excluded, including:

Services will be rendered with due care and skill
Services will be fit for the purpose disclosed
Services will be delivered within a reasonable time

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Data Security

12.1 Your Responsibility

You are responsible for:

Backing up your saved calculations
Securing your device and internet connection
Logging out of shared devices

12.2 No Guarantee

While we implement security measures, we cannot guarantee absolute security. Use the Service at your own risk.

13. Third-Party Services

16. Termination

Before initiating legal action, you agree to contact us at support@supercalcpro.com.au to attempt informal resolution.

18.2 Mediation

If informal resolution fails, both parties agree to attempt mediation before litigation.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SuperCalc Pro regarding the Service.

21. No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

22. Assignment

You may not assign these Terms without our consent. We may assign these Terms to any affiliate or successor.
